Unsolicited Advertisements

The law prohibits the sending of unsolicited advertisements, or junk faxes, by facsimile transmission. A loophole was added to this law in 2005, making it legal to send unsolicited faxes if a previous business relationship existed between the sender and the recipient. Defining a previous business relationship can be tricky, and requires an experienced attorney knowledgeable about the 1991 Telephone Consumer Protection Act (TCPA) and the 2005 update, The Junk Fax Protection Act.

The law does not prohibit sending junk mail like unsolicited advertising flyers, requests for donations, and free samples. However, the law does protect you from unsolicited faxes.
